USER AGREEMENT (PUBLIC OFFER)

This User Agreement (hereinafter referred to as the “Agreement”) is a legally binding contract (public offer) between the Administration of the website https://skgroup.top (hereinafter referred to as the “Executor” / “Administration”) and any individual or legal entity visiting the website or using its services (hereinafter referred to as the “User”).

Using the Website, filling out any feedback forms, as well as clicking on links to communicate in messengers (including Telegram) constitutes the User’s unconditional consent to all clauses of this Agreement. If the User does not agree with these terms, they must immediately cease using the Website.

1. TERMS AND DEFINITIONS

  • Website — the internet resource located on the Internet at https://skgroup.top, including all its subdomains, text, graphic materials, and software.
  • Administration / Executor — the SK Group brand, which owns the rights to the Website and provides the services presented on the Website.
  • User — any legally capable individual or representative of a legal entity who accesses the Website.
  • Website Services — forms for ordering an express audit, buttons for switching to messengers, text materials, case studies, and feedback forms.

2. SUBJECT OF THE AGREEMENT AND SERVICES PROVIDED

2.1. The Website is for informational and educational purposes and presents SK Group’s services in the following areas:

  • System audit of business and IT management;
  • Technical Project / Product Manager services (website architecture design, e-commerce systems, drafting technical specifications);
  • Fractional Chief Operating Officer (COO) services (operational activity audit, building organizational structures, regulations, and KPIs);
  • Crisis B2B marketing and lead generation (Google Ads setup, Google Analytics 4).

2.2. Ordering a specific service, fixing stages, costs (including the cost of leads, advertising budgets, and integrations) and KPIs are regulated by a separate Service Agreement concluded between the Executor and the User in written or electronic form. Information on the Website does not constitute a final commercial offer.

3. RIGHTS AND OBLIGATIONS OF THE PARTIES

3.1. The User has the right to:

  • Familiarize themselves with the materials of the Website, case studies, and the technology stack of SK Group.
  • Submit requests for a 15-minute express audit or consultation through forms on the Website or by clicking to switch to Telegram.

3.2. The User undertakes to:

  • Provide accurate contact information (name, phone number, messenger nickname) when filling out feedback forms.
  • Not use automated scripts (bots, scrapers) to collect information from the Website or disrupt its operation.

3.3. The Administration has the right to:

  • At any time, change the design of the Website, structure, stack of tools used, description of case studies, and the terms of this Agreement without prior notice to the User.
  • Restrict the User’s access to the Website in case of violation of the terms of this Agreement.

4. LIMITATION OF LIABILITY (DISCLAIMER)

4.1. All case studies and financial metrics (for example, a 3x increase in revenue, lead cost from 15–80 UAH) posted on the Website are a demonstration of the real experience of SK Group in specific enterprises during a certain historical period. The Executor does not guarantee identical or automatic results for the User’s business, as they directly depend on the individual architecture, niche, management involvement, and market conditions of the User.

4.2. The Administration is not responsible for temporary technical failures in the operation of the Website, hosting, or third-party API services (including Telegram widgets).

4.3. Information obtained during the 15-minute express audit is of a purely advisory nature.

5. INTELLECTUAL PROPERTY

5.1. All text materials, descriptions of case studies (“Persona Grata”, “Krantechservice”, “Agrobaza”, etc.), logos, graphic elements, and trademarks of SK Group posted on the Website are protected by copyright law.

5.2. Copying, quoting, or commercial use of the Website materials without a direct indexed link to https://skgroup.top and the written consent of the Administration is strictly prohibited.

6. CONFIDENTIALITY AND PERSONAL DATA

6.1. Processing of the User’s personal data (name, phone number, cookie data) left on the Website is carried out by the Executor in accordance with the Website’s Privacy Policy and the requirements of personal data protection legislation.

6.2. The purpose of data collection is to communicate with the User to conduct an initial audit, consultation, and coordinate further IT or operational management.

7. INTERNATIONAL REGULATION AND APPLICABLE LAW

7.1. Applicable Law and Jurisdiction:

  • This Agreement and all legal relations associated with the use of the Website https://skgroup.top are governed by the current legislation of Ukraine.
  • All disputes that cannot be resolved through peaceful negotiations shall be considered by a competent court at the location of the Executor (in accordance with the procedural law of Ukraine).

7.2. International Users (Cross-Border Transfer):

  • The Website is accessible to users worldwide. If you access the Website from outside Ukraine, you are solely responsible for compliance with the local laws of your jurisdiction.
  • Accessing Website materials from countries where its content is deemed illegal is prohibited.

7.3. Compliance with the EU General Data Protection Regulation (GDPR):

  • If the User is a resident of the European Economic Area (EEA) or the European Union (EU), the processing of their personal data is regulated in accordance with the GDPR.
  • The Executor guarantees such Users the right to access, rectify, restrict processing, or completely delete (“the right to be forgotten”) their personal data upon the first official request to the Executor’s contacts.
  • By clicking the “Analyze my task in Telegram” button or filling out forms, the User gives express consent to the cross-border transfer of data to the Executor’s servers.

8. RULES OF INTERACTION IN MESSENGERS (TELEGRAM)

8.1. Switching to External Communication Channels:

  • By clicking the “Analyze my task in Telegram” button (or similar links to messengers) on the Website, the User consciously switches to the third-party platform Telegram (Telegram FZ-LLC / Telegram Messenger Inc.). From this moment on, Telegram’s Terms of Service and Privacy Policy apply to the technical side of data transmission.

8.2. Legal Status of Correspondence:

  • All data, text messages, technical specifications (TS), screenshots, files, and organizational charts transferred by the User to the Executor during consultations in Telegram are recognized as confidential information.
  • Electronic correspondence in Telegram sent from accounts verified by the Parties during the initial call has legal force and can be used as evidence in the event of disputes prior to the conclusion of an official Agreement.

8.3. Limitation of Liability for Free Consultations:

  • Information, recommendations, and express audits provided by the Executor within the free 15-minute consultations in Telegram are for informational purposes only. The Executor is not liable for any direct or indirect damages resulting from the independent implementation of these recommendations by the User prior to signing a full contract.

8.4. Security and Verification:

  • The Website Administration is not responsible for the actions of scammers using similar nicknames (fake clone accounts of SK Group in Telegram). The only authentic communication channel is the one the User accessed directly via the verified link from the Website https://skgroup.top.
  • The User undertakes not to transfer passwords, access to servers, databases, CRM systems, or bank details via Telegram until the security protocol is officially agreed upon.

9. FINAL PROVISIONS

9.1. This Agreement enters into force from the moment the User enters the Website and is valid indefinitely.

9.2. All disputes arising under this Agreement shall be resolved through negotiations.
